Cookies can then be distinguished in technical and profiling cookies.

Profiling cookies are aimed to create user profiles and are used in order to send advertising messages targeted for the user or group of people where user belongs. The use of profiling cookies requires the consent of the interested party.

Technical cookies are used for the sole purpose of “transmitting a communication over an electronic communication network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service “(see article 122, paragraph 1 of the Privacy Code).

Technical cookies are those used exclusively with a view to “carrying out the transmission of a communication on an electronic communications network, or insofar as this is strictly necessary to the provider of an information society service that has been explicitly requested by the contracting party or user to provide the said service.” (see Section 122(1) of the Code). They include browsing or session cookies.
